By accessing or using FoundYa's website, mobile applications, NFC tags, and related services (the "Services"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Services. We may update these Terms; continued use after changes constitutes acceptance of the revised Terms.
You must be able to form a binding contract in your jurisdiction to use the Services. If you use the Services on behalf of an organisation, you represent that you have authority to bind that organisation.
You are responsible for safeguarding your account credentials and for activity under your account. You must provide accurate information and keep it current. Notify us promptly of unauthorised use.
FoundYa provides tools to create and manage pet profiles, configure NFC tags, and receive notifications when tags are scanned or other events occur, as described in our product materials. Features may change, be suspended, or require updates. We do not guarantee uninterrupted or error-free operation.
The Services are intended to support pet identification and recovery; they are not a substitute for supervision, veterinary care, or compliance with local laws. Information shown to finders depends on your settings and what others submit. We are not responsible for the actions of finders, scanners, or other third parties.

We may suspend or terminate access for violations or risk to the Services or users.
We and our licensors own the Services, branding, software, and content we provide (excluding your content). You retain rights to content you submit; you grant us a licence to host, process, and display it as needed to operate the Services and as configured in your settings (for example public pet profiles).
Orders, shipping, returns, and subscriptions are subject to applicable product pages, checkout terms, and Australian consumer law. Prices and availability may change. Taxes and fees may apply as shown at purchase.
To the maximum extent permitted by law, the Services are provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Nothing in these Terms excludes, restricts, or modifies any non-excludable guarantee or right under the Australian Consumer Law.
To the maximum extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or goodwill. Our total liability for any claim arising from these Terms or the Services is limited to the greater of amounts you paid us for the Services in the twelve (12) months before the claim or AUD $100, except where liability cannot be limited by law (including under the Australian Consumer Law).
You will indemnify and hold harmless FoundYa and its affiliates, directors, and employees from claims, damages, and expenses (including reasonable legal fees) arising from your use of the Services, your content, or your breach of these Terms, except to the extent caused by our gross negligence or wilful misconduct.
You may stop using the Services at any time. We may suspend or terminate access for breach of these Terms, risk, or operational reasons, with or without notice where permitted by law. Provisions that by nature should survive will survive termination.
These Terms are governed by the laws of Australia. You submit to the non-exclusive jurisdiction of courts in Australia.
